Chandini was a five-year-old student who migrated from the state of Bihar to the state of Kerala in India. [1] She lived with her parents in a rented flat in Choornikkara village, Aluva and was a class one student at the Thaikkattukara UP school. Chandini went missing around 3:30 pm on 28 July 2023. Her body was found abandoned in a sack 21 hours later near the Aluva market area. After the post-mortem, the police confirmed that she was strangled to death after being sexually assaulted. [2] On 4 November 2023, Special POCSO court judge convicted Ashfaq Alam, a migrant labourer, for raping and killing Chandini. [3] He was sentenced to death on 14 November 2023. [4]

Kidnapping and killing

On 28 July 2023, Chandini was allegedly abducted by Ashfaq Aslam, a native of Assam. [5] They were in the Aluva market around 3:30 pm and he walked behind her. Seeing him and the girl, some people were suspicious, but the accused replied that it was his child. The accused then allegedly came to a secluded place behind the market, sexually assaulted Chandini, and killed her around 5:30 pm. [6] The inquest revealed that there was a wound on her genitals. The accused had allegedly strangled her with her own clothes, and hit her face with a stone. After confirming her death, he allegedly put plastic covers and sacks over her body. [7]

Investigation

After CCTV footage showed Chandini accompanying Aslam to the neighbouring bus stop, the police detained him,. He had moved in to live in the floor above Chandini's home two days earlier. The girl remained missing even after police tracked down Aslam near Thottakkattukara in Aluva around 10.45 pm. [8] He was in an intoxicated state, the police claimed, making it impossible to get information out of him. In the morning, Aluva market employees told the police that they had seen a man with a child there, the night before. Aslam initially told the police that he had given the child to a man named Zakir, after becoming sober the next morning. [9] However, later he admitted to the crime. The body was then discovered on the banks of the Periyar river in the market area about noon, where trash is deposited behind the market. Later, Chandini's body was identified by her fatherIn this case. 41 witnesses in all were questioned. Ashfaq was tested with an interpreter present. Within 30 days, the police completed their investigation and submitted the chargesheet to the court. [10]

Trial and verdict

The trial, which started on October 4, was completed in 26 days. A ruling issued on 4 November 2023, the judge found that the accused Ashfaq Alam is guilty of sixteen counts under the Juvenile Justice (Care and Protection of Children) Act, the Protection of Children from Sexual Offenses (POCSO) Act, and the Indian Penal Code. Sixteen charges were brought against him, including murder, kidnapping, rape, and unnatural sex. [11] The Ernakulam POCSO court pronounced the verdict of the case on 14 November 2023. The accused Ashfaq Alam was awarded capital punishment by judge K. Soman. [12]

The Suryanelli rape case refers to a case of kidnapping and subsequent rape of a 16-year-old school girl from Suryanelli, Kerala, India, in 1996. The girl was allegedly lured with the promise of marriage on 16 January 1996 and kidnapped. She was allegedly raped by 37 of the 42 accused persons, over a period of 40 days. The remaining had abetted the crime. After P.J. Kurien, the then Union Minister and later Rajya Sabha Deputy Chairman belonging to UDF led by Congress party, was named, the issue was politicised, due to a then upcoming general election. Several women's rights activists like K. Ajitha and Suja Susan George, and women's organisations, like NFIW and Anweshi, have taken an interest in the case.

Child sexual abuse laws in India have been enacted as part of the child protection policies of India. The Parliament of India passed the 'Protection of Children Against Sexual Offences Bill (POCSO), 2011' regarding child sexual abuse on 22 May 2012, making it an Act. A guideline was passed by the Ministry of Women and Child Development, India. The rules formulated by the government in accordance with the law had also been notified on the November 2012 and the law had become ready for implementation. There have been many calls for more stringent laws.

Punishment for rape in Pakistan under the Pakistani laws is either death penalty or imprisonment of between ten and twenty-five years. For cases related to gang rape, the punishment is either death penalty or life imprisonment. DNA test and other scientific evidence are used in prosecuting rape cases in Pakistan.

Rape is the fourth most common crime against women in India. According to the 2021 annual report of the National Crime Records Bureau (NCRB), 31,677 rape cases were registered across the country, or an average of 86 cases daily, a rise from 2020 with 28,046 cases, while in 2019, 32,033 cases were registered. Of the total 31,677 rape cases, 28,147(nearly 89%) of the rapes were committed by persons known to the victim. The share of victims who were minors or below 18 – the legal age of consent – stood at 10%.

On 27 May 2014, a gang rape and murder of two teenage girls was reported in the Katra village of Budaun district, Uttar Pradesh, India. It was widely reported in the press in India as well as overseas. After an extensive investigation, CBI concluded that there was no gang rape and the suspects were released. However, on 28 October 2015 the POCSO court rejected the CBI closure report; it was a major setback for CBI.

Darbara Singh was an Indian serial killer who was convicted of two murders.

The murder of Kayleigh Haywood, a 15-year-old girl from Measham, Leicestershire, took place in November 2015, following online grooming by Luke Harlow, a 27-year-old man who had contacted her on the social networking website Facebook.

<span class="mw-page-title-main">Kathua rape case</span> 2018 crime in Jammu and Kashmir, India

The Kathua rape case involved the abduction, gang rape, and murder of an 8-year-old girl, Asifa Bano, by six men and a juvenile, in January 2018 in the Rasana village near Kathua in Jammu and Kashmir, India. A chargesheet for the case was filed, the accused were arrested and the trial began in Kathua on 16 April 2018. The victim belonged to the nomadic Bakarwal community. She disappeared for a week before her body was discovered by the villagers a kilometer away from the village. The incident made national news when charges were filed against eight men in April 2018. The arrests of the accused led to protests by the Panthers Party and other local groups, who sought justice for the victim. A protest in support of the accused men was attended by two ministers from the Bharatiya Janata Party, both of whom later resigned. The gang rape and murder, as well as the support the accused received, sparked widespread outrage in India and world-wide.

The Unnao rape case refers to the gang rape of a 17-year-old girl on 4 June 2017 in Unnao, Uttar Pradesh, India. On 9 December 2019, the rape victim was set on fire on her way to testify against her alleged rapists and died of her injuries with 90% burns. On 16 December 2019, former MLA Kuldeep Singh Sengar was convicted for the rape on 20 December 2019 and sentenced to life imprisonment. Further, Sengar was found guilty in the death of the girl's father in judicial custody.

Muzaffarpur Shelter Home Rape case refers to a shelter home that ran under a non-governmental organization called "Sewa Sankalp Evam Vikas Samiti" at Muzaffarpur, Bihar, where cases of sexual abuse, rape and torture were reported. In a medical examination, sexual abuse of 34 out of 42 of the girls living at the shelter was confirmed.

The Aligarh murder case involved the death of a two-year-old girl in the Aligarh district of Uttar Pradesh, India. She went missing on 30 May 2019, and her body was found three days later in a garbage dump. Police stated that the girl was abducted and killed in a form of revenge crime over a monetary dispute. The murder caused widespread outrage, which led to the spread of misinformation on social media as rumours were circulated.

In November 2019, the gang rape and murder of a 26-year-old veterinary doctor in Shamshabad, near Hyderabad, sparked outrage across India. Her body was found in Shadnagar on 28 November 2019, the day after she was murdered. Four suspects were arrested and, according to the Cyberabad Metropolitan Police, confessed to having raped and killed the doctor.

<span class="mw-page-title-main">Murder of Patricia Alatorre</span> California murder case

Patricia Jocelyn Alatorre was a teenager from Bakersfield, California who was raped and murdered after disappearing on July 1, 2020. Alatorre and her killer met through social media and shared explicit photos of themselves, with the suspect convincing Alatorre to meet up on two occasions. On the second meeting, Alatorre was raped and strangled to death, with the killer having sex with the body before burning it. Armando Cruz was arrested after police found a white pick up truck similar to the one used during the kidnapping. Alatorre's rape and death has been described by the Bakersfield Police Department as one of the worst missing children cases they have ever had.

On 4 April 2022, a 14-year-old girl was raped in Hanskhali of Nadia district, West Bengal, India. The main accused are Brojogopali Gayali and his friends. Notably they are associated with TMC.

On April 24, 2022, Liliana "Lily" Peters, a 10-year old American girl, was killed and raped in Chippewa Falls, Wisconsin. The killing gained significant attention and media coverage due to the ages of both the victim and the suspect.
