Mechanization and Modernization Agreement 1960

The Mechanization and Modernization (M&M) Agreement of 1960 was an agreement reached by California longshoremen unions: International Longshore and Warehouse Union (ILWU), the International Longshoremen's Association (ILA), and the Pacific Maritime Association. This agreement applied to workers on the Pacific Coast of the United States, the West Coast of Canada, and Hawaii. The original agreement was contracted for five years and would be in effect until July 1, 1966.

Origins

Prior to the 1940s, the majority of cargo movement in ports were mainly done by hand and required a large number of skilled workers. There were some new technologies that were introduced in order to aid in the movement of shipments, such as rope slings, dollys, forklifts, and even cranes that helped longshoremen take large loads off of ships. However, longshoremen were still needed as they were skilled to maximize the space in each container. [1] The methods of cargo movement differed greatly between each port on the Pacific Coast. Depending on the size of the cargo and what was being shipped, many ports required extensive manual labor of dock workers while others required the use of specialized mechanical cranes to hoist large truck containers off of ships. [2] After World War II, the demand for a more efficient way of loading and unloading cargo brought new technology to ports that would require less workers to move shipments.

Provisions

Harry Bridges, then current leader of the ILWU, designed the Mechanization and Modernization Agreement, which was signed on October 18, 1960. [2] :670–672 It distinguished between 3 classes of longshoremen workers. Depending on the level of worker, each worker could guarantee a certain set of benefits. [2] :665

The M&M Agreement guaranteed employment security for the basic workforce, which were registered union members ("A" men). If there were to be a decent decline in employment due to modernization, there would be a decline in the employment of "B" men and Casual workers in order to prevent the loss of employment to the basic workforce. However, the ILWU asked that the Agreement also shorten weekly work shifts from 40 hours to 35 hours per week in order to accommodate the basic workforce and maintain equal wages among workers. Employers would be able to introduce new technology and device that would improve the ports productivity, efficiency, and reduce the number of labor forces needed. [3]

Criticisms

Although the M&M Agreement, provided employment security for ILWU members, it failed in preventing the Longshoremen's Strike of 1971. The M&M Agreement failed to fully adapt to the introduction of technology and containerization at ports. [4] The introduction of technology greatly reduced the need for labor by up to 90% and employers preferred to employ permanent workers ("A" men) rather than others, thus creating an imbalance between workers and wages. Also dock jobs were being placed outside of port areas and jobs were now being disputed between different unions. [3] :7 Whereas, employers of longshoremen were continuing making a profit from the reduction of labor. In July 1971, 12,000 longshoremen walked out on California ports; however, it was deemed a failure since the strike failed to achieve significant economic harm to employers. Without support from Harry Bridges, the ILWU leader, a Los Angeles court ordered all workers back to work. Although Bridges, attempted to reconcile with workers by creating a new contract, the contract failed to live up to expectations and "B" men and Casual workers were unemployed. [5]

Significance and legacy

Since the Mechanization and Modernization Agreement, the ILWU had attempted to bring other unorganized, nonunion waterfront occupations into the union as a means to counteract new technology at ports. The ILWU has since expanded its jurisdiction as to maintain high employment for its members. Although organization of these occupations was met with employer resistance, the ILWU managed to absorb new jurisdiction. The Mechanization and Modernization Agreement of 1960, provided job security to members, but did not extend its benefits to those outside of the ILWU.

He was prosecuted for his labor organizing and designated as subversive by the U.S. government during the 1930s, 1940s, and 1950s, with the goal of deportation. This was never achieved.

United States labor law sets the rights and duties for employees, labor unions, and employers in the United States. Labor law's basic aim is to remedy the "inequality of bargaining power" between employees and employers, especially employers "organized in the corporate or other forms of ownership association". Over the 20th century, federal law created minimum social and economic rights, and encouraged state laws to go beyond the minimum to favor employees. The 1934 West Coast Waterfront Strike lasted 83 days, and began on May 9, 1934 when longshoremen in every US West Coast port walked out. Organized by the International Longshore and Warehouse Union (ILWU), the strike peaked with the death of two workers on "Bloody Thursday" and the San Francisco General Strike which stopped all work in the major port city for four days and led ultimately to the settlement of the West Coast Longshoremen's Strike.

<span class="mw-page-title-main">International Longshore and Warehouse Union</span> Labor union

The International Longshore and Warehouse Union (ILWU) is a labor union which primarily represents dock workers on the West Coast of the United States, Hawaii, and in British Columbia, Canada. The union was established in 1937 after the 1934 West Coast Waterfront Strike, a three-month-long strike that culminated in a four-day general strike in San Francisco, California, and the Bay Area. It disaffiliated from the AFL–CIO on August 30, 2013.

The ILWU 1971 strike began on July 1, 1971, when members of the International Longshore and Warehouse Union (ILWU) walked out against their employers, represented by the Pacific Maritime Association (PMA). The union's goal was to secure employment, wages, and benefits in the face of increased mechanization, shrinking workforce, and the slowing economic climate of the early 1970s. The strike shut down all 56 West coast ports, including those in Canada, and lasted 130 days, the longest strike in the ILWU's history.

During the strike wave of 1945–46 a strike of almost 3,500 tugboat workers occurred on Monday February 1, 1946. The expectations of the strike were to bring the world's busiest harbor to a virtual standstill. Captain William Bradley, president of Local 333, United Maritime Division, International Longshoremen's Association, stated two days before the actual strike that a strike vote had been taken the previous week-end, during a breakdown of negotiations with the Employers Wage Adjustment Committee, which represents the owners and operators in this port.

The Longshore Strike 1948 was an industrial dispute which took place in 1948 on the west coast of the United States. President of the ILWU at the time was Harry Bridges. The WEA led by Frank P. Foise were in a conflict, they were unable to come to agreeable terms and with the issues of hiring and the politics of union leadership, longshoremen and marine unions performed a walk out on September 2, 1948.
The strike shut down the United States’ West Coast ports and put a dent in American labor history and a positive change for future longshoremen.

The Portland Waterfront strike of 1922 was a labor strike conducted by the International Longshoremen's Association which took place in Portland, Oregon from late April to late June 1922. The strike was ineffective at closing down the Port of Portland due to strikebreakers, and on June 22 the strike ended with the employers dictating terms.

In the late 1870s, Squamish and Tsleil-Waututh communities on the North Shore of Burrard Inlet experienced an increase of physical and economic encroachment from the expansion of neighbouring Vancouver. Faced with urbanization and industrialization around reserve lands, Squamish and Tsleil-Waututh traditional economies became increasingly marginalized, while government-imposed laws increasingly restricted Native fishing, hunting, and access to land and waters for subsistence. International Longshoremen's Association, AFL-CIO v. Allied International, Inc., 456 U.S. 212 (1982), was a United States Supreme Court case which held that a trade union that refused to unload cargo from the Soviet Union in protest against the invasion of Afghanistan had engaged in a secondary boycott, an unfair labor practice under the National Labor Relations Act.

In 2012, members of the International Longshore and Warehouse Union were locked out by the employers at the ports of Los Angeles and Long Beach in the U.S. state of California. This was due to issues over labor contract negotiations between port employers and the ILWU's Local 63 Office and Clerical Unit (OCU), which represents about 800 clerical workers at the ports. In 2010, the existing labor contract with the OCU expired, and the union and employers disagreed on the terms of a new contract. The main issue regarded job security, with the union accusing the employers of excessive outsourcing and the employers countering that the union was featherbedding. Negotiations would continue for over 2 years.
