The Convention on Transit Trade of Land-locked States is a multilateral treaty that addresses international rules allowing for land-locked countries to transport goods to and from seaports. The convention imposes obligations on both land-locked states and on coastal states that ratify the treaty.

Contents

The convention was concluded at the United Nations Conference on Transit Trade of Land-locked Countries, which had been established by the United Nations General Assembly. It was concluded and signed on 8 July 1965. The treaty came into force on 9 June 1967.

Coastal states that ratify the convention (known as "transit states") [1] agree to make arrangements with land-locked states that are party to the treaty that wish to transit goods across the territory of the transit state to or from a coastal port in the transit state. The transit states agree that they will not discriminate based on place of origin or destination of the goods being transported. The land-locked states agree to be responsible for any expenses that the transit states incur in supervising or protecting the transit of the land-locked state's goods.

The convention has been noted as the first international agreement to recognise the special disadvantaged position of land-locked states. [2]

As of June 2014, the treaty has been ratified by 43 states, made up of an approximately even split of land-locked and coastal states. The convention has essentially been superseded by the United Nations Convention on the Law of the Sea, which contains similar provisions for transit arrangements to be made between coastal and land-locked states.

The Landlocked developing countries (LLDC) are developing countries that are landlocked. The economic and other disadvantages experienced by such countries makes the majority of landlocked countries the Least Developed Countries (LDCs), with inhabitants of these countries occupying the bottom billion tier of the world's population in terms of poverty. Apart from Europe, there is not a single successful highly developed landlocked country as measured by the Human Development Index (HDI), and nine of the twelve countries with the lowest HDI scores are landlocked. Landlocked European countries are exceptions in terms of development outcomes due to their close integration with the regional European market. Landlocked countries that rely on transoceanic trade usually suffer a cost of trade that is double that of their maritime neighbours. Landlocked countries experience economic growth 6% less than their non-landlocked countries, holding other variables constant.

An international zone is any area not fully subject to the border control policies of the state in which it is located. There are several types of international zones ranging from special economic zones and sterile zones at ports of entry exempt from customs rules to concessions over which administration is ceded to one or more foreign states. International zones may also maintain distinct visa policies from the rest of the surrounding state.

Freedom of navigation (FON) is a principle of customary international law that ships flying the flag of any sovereign state shall not suffer interference from other states, apart from the exceptions provided for in international law. In the realm of international law, it has been defined as “freedom of movement for vessels, freedom to enter ports and to make use of plant and docks, to load and unload goods and to transport goods and passengers". This right is now also codified as Article 87(1)a of the 1982 United Nations Convention on the Law of the Sea. The Barcelona Convention and Statute on Freedom of Transit is an International treaty signed in Barcelona on 20 April 1921; the treaty ensures freedom of transit for various commercial goods across national boundaries. It was registered in League of Nations Treaty Series on 8 October 1921. It went into effect on 31 October 1922. The convention is still in force at present.

The Nepal–Britain Treaty was first discussed in 1921 and the final treaty was signed on 21 December 1923 in Singha Durbar. The treaty was the first formal acknowledgement by the British that Nepal, as an independent nation, had the right to conduct its foreign policy in any way it seems fit and is considered to be “a great achievement of 25 years of Chandra Shumsher’s diplomacy.” The treaty was recorded in 1925 in the League of Nations.

The Declaration recognising the Right to a Flag of States having no Sea-coast is a 1921 multilateral treaty which legally recognised that a land-locked state could be a maritime flag state; that is, that a land-locked state could register ships and sail them on the sea under its own flag.

The International Convention on the Harmonization of Frontier Controls of Goods is a 1982 United Nations Economic Commission for Europe (UNECE) treaty whereby states agree to co-operate in harmonizing and simplifying international border control. For goods in transit, the states that ratify the Convention agree to implement "simple and speedy treatment ... by limiting their inspections to cases where these are warranted by the actual circumstances or risks".

The Afghanistan–Pakistan Transit Trade Agreement is a bilateral trade agreement signed in 2010 by Pakistan and Afghanistan that calls for greater facilitation in the movement of goods amongst the two countries.
