Same-sex marriage is legal in the following countries: Andorra, Argentina, Australia, Austria, Belgium, Brazil, Canada, Chile, Colombia, Costa Rica, Cuba, Denmark, Ecuador, Estonia, Finland, France, Germany, Greece, Iceland, Ireland, Luxembourg, Malta, Mexico, the Netherlands, [nb 1] New Zealand, [nb 2] Norway, Portugal, Slovenia, South Africa, Spain, Sweden, Switzerland, Taiwan, the United Kingdom, [nb 3] the United States, [nb 4] and Uruguay.

Same-sex marriage is recognized, but not performed, in Israel and Namibia. Furthermore, same-sex marriages performed in the Netherlands are recognized in Aruba, Curaçao and Sint Maarten. Whether same-sex couples should be allowed to marry has been and remains the topic of debate worldwide. 32 countries and four jurisdictions worldwide have passed constitutional amendments that explicitly prohibit the legal recognition of same-sex marriage and sometimes other forms of legal unions as well. Sixteen countries and 34 jurisdictions worldwide have authorized civil unions or unregistered cohabitation for same-sex couples as an alternative to marriage. The legal name of those unions as well as the number of rights that they provide can vary greatly.

Legislative efforts to recognise same-sex unions

National level

The first legislation of unregistered cohabitation was introduced in the Netherlands in June 1979. [1] [2] However, the first substantial recognition of same-sex couples did not occur before the introduction of a new legal form, that of registered partnerships, which was first enacted in Denmark in June 1989. [3] Many countries have followed with similar legislation since then. Legislation of these forms of legal unions still occur with a variety of different names, even after the introduction of same sex marriage, although sometimes they are overwritten by subsequent legislation of same-sex marriage.

There are currently 11 countries that have an alternative form of legal recognition other than marriage on a national level. Those are Bolivia, Croatia, Cyprus, the Czech Republic, Hungary, Israel, Italy, Liechtenstein, Monaco, Montenegro and San Marino.

As of 10 May 2024, legislation to allow an alternative form of legal recognition of same-sex couples other than marriage is pending, or has passed at least one legislative house on a national level in Lithuania and Ukraine.

As of 10 May 2024, same-sex marriage has been legal (nationwide or in some parts) in Andorra, Argentina, Australia, Austria, Belgium, Brazil, Canada, Chile, Colombia, Costa Rica, Cuba, Denmark, Ecuador, Estonia, Finland, France, Germany, Greece, Iceland, Ireland, Luxembourg, Malta, Mexico, the Netherlands, [nb 1] New Zealand, [nb 2] Norway, Portugal, Slovenia, South Africa, Spain, Sweden, Switzerland, Taiwan, the United Kingdom, [nb 3] the United States [nb 4] and Uruguay.

As of 10 May 2024, legislation to allow same-sex marriage is being considered in at least one legislative house on a national level in Japan, Liechtenstein, Thailand and Venezuela.

Sub-national level

In countries with a federal system of governance, states and territories often may grant recognition to same-sex couples in their own jurisdictions, although unitary states with a level of devolution, such as Spain or the United Kingdom, also offer such powers to local authorities. The first jurisdiction to enact unregistered cohabitation was British Columbia in Canada in July 1992. The first jurisdiction to legalize registered partnership was Greenland as part of the Kingdom of Denmark in April 1996. Finally, the first sub-national jurisdiction to legalize same-sex marriage was the Canadian province of Ontario in June 2003.

As of 10 May 2024, there are 15 sub-national jurisdictions worldwide that have legalized some kind of alternative form of legal union of same-sex couples other than marriage. Those are:

Constitutional efforts

Thirty-two countries have passed constitutional amendments banning a variety of same-sex unions. These amendments have taken several forms. Some are limited to banning only marriage. Others ban marriage and prohibit legislation providing "similar rights".

National level

Cuba was the first country to prohibit same-sex marriage in February 1976. Paraguay, Honduras and Bolivia are the only cases that not only marriage is prohibited but also de facto unions[ citation needed ]. Vietnam, Cuba, and Ecuador repealed their same-sex marriage bans in November 2013, April 2019, and June 2019, respectively.

As of 10 May 2024, thirty-three countries prohibit same-sex marriage on a national level. Those are Armenia, Belarus, Bolivia, Bulgaria, Burkina Faso, Burundi, Cambodia, the Central African Republic, Croatia, the Democratic Republic of the Congo, Dominican Republic, Georgia, Honduras, Hungary, Jamaica, Kenya, Kyrgyzstan, Latvia, Lithuania, Mali, Moldova, Mongolia, Montenegro, Palau, Paraguay, Poland, Russia, Rwanda, Serbia, Slovakia, South Sudan, Uganda, Ukraine, Venezuela and Zimbabwe.

Sub-national level

The first jurisdiction to explicitly ban same-sex marriage in its Constitution was the U.S. state of Alaska in November 1998, however, same-sex marriage was legalised in the state in October 2014. The first jurisdiction to enact such a ban was Yucatán, in July 2009, but since August 2010 the state recognizes same-sex marriages performed in Mexico and in August 2021 local congress removed the heterosexual definition of marriage from the state's constitution.

It begins with the history of same-sex unions during ancient times, which consisted of unions ranging from informal and temporary relationships to highly ritualized unions, and continues to modern-day state-recognized same-sex marriage. Same-sex marriage has been legal in Chile since 10 March 2022. In June 2021, President Sebastián Piñera announced that his government would sponsor a bill to legalize same-sex marriage. The Senate of Chile passed the legislation on 21 July 2021, and the Chamber of Deputies gave its approval on 23 November 2021. Disagreements on some aspects of the bill led to the formation of a mixed commission to discuss it. Both chambers of the National Congress approved an identical version of the bill on 7 December 2021. President Piñera signed the legislation into law on 9 December, and it was published in the Diario Oficial de la República de Chile on 10 December. The law took effect 90 days later, with the first same-sex marriages taking place on 10 March 2022. Chile was the sixth country in South America and the 29th in the world to allow same-sex couples to marry.

Same-sex marriage has been legal in Uruguay since August 5, 2013. A bill for legalization was passed by the Chamber of Representatives on December 12, 2012, in a vote of 81–6. The Senate approved it with some minor amendments on April 2, 2013, in a 23–8 vote. The amended bill was approved by the Chamber of Representatives in a 71–21 vote on April 10 and was signed into law by President José Mujica on May 3, 2013. It took effect on August 5. Uruguay was the third country in South America, after Argentina and Brazil, and the fourteenth in the world to legalize same-sex marriage.

<span class="mw-page-title-main">Same-sex marriage in Mexico</span>

Same-sex marriage is legally recognized and performed throughout Mexico since 31 December 2022. On 10 August 2010 the Supreme Court of Justice of the Nation ruled that same-sex marriages performed anywhere within Mexico must be recognized by the 31 states without exception, and fundamental spousal rights except for adoption have also applied to same-sex couples across the country. Mexico was the fifth country in North America and the 33rd worldwide to allow same-sex couples to marry nationwide.

<span class="mw-page-title-main">LGBT rights in Panama</span>

Lesbian, gay, bisexual, and transgender (LGBT) people in Panama face legal challenges not experienced by non-LGBT residents. Same-sex sexual activity is legal in Panama, but same-sex couples and households headed by same-sex couples are not eligible for the same legal benefits and protections available to opposite-sex married couples.

Several countries in the Americas grant legal recognition to same-sex unions, with almost 85 percent of people in both North America and South America living in jurisdictions providing marriage rights to same-sex couples.

<span class="mw-page-title-main">LGBT rights in the Americas</span>

Laws governing lesbian, gay, bisexual, and transgender (LGBT) rights are complex and diverse in the Americas, and acceptance of LGBT persons varies widely.

Same-sex marriage has been legal in Ecuador since 8 July 2019 in accordance with a Constitutional Court ruling issued on 12 June 2019 that the ban on same-sex marriage was unconstitutional under the Constitution of Ecuador. The ruling took effect upon publication in the government gazette on 8 July. Ecuador became the fifth country in South America to allow same-sex couples to marry, after Argentina, Brazil, Uruguay and Colombia, but adoption by married couples remains restricted to opposite-sex couples. The country has also recognized same-sex civil unions since 2008.

Same-sex marriage has been legal in Chihuahua since 12 June 2015. By statute, in Mexico, if any five rulings from the courts on a single issue result in the same outcome, legislatures are bound to change the law. In the case of Chihuahua, more than 20 individual amparos were decided with the same outcome, yet the Congress did not act. In anticipation of the Supreme Court of Justice of the Nation ordering the Congress to act, Governor César Duarte Jáquez announced on 11 June that there would be no further prohibition in the state. Marriage licenses became available the following day, 12 June 2015. Chihuahua was the third Mexican state to legalize same-sex marriage, after Quintana Roo and Coahuila.

Same-sex marriage has been legal in Guerrero since 31 December 2022. After the Supreme Court of Justice of the Nation ruled that same-sex marriage bans are unconstitutional nationwide under the Constitution of Mexico on 12 June 2015, officials in Guerrero began announcing plans for a collective group wedding. Governor Rogelio Ortega Martínez submitted a same-sex marriage bill to Congress on 7 July 2015 and instructed civil registrars to issue marriage licenses to same-sex couples. Legislators lamented they would have preferred to have the bill passed before marriages took place, but given the time line presented, it was unlikely. On 10 July 2015, twenty same-sex couples were married by Ortega Martínez in Acapulco.

Same-sex marriage has been legal in Sonora since 22 October 2021. On 23 September 2021, the Congress of Sonora voted 25–8 to pass a law legalizing same-sex marriage. The legislation was published in the state's official gazette on 21 October, and took effect the following day. Sonora was the 21st Mexican state to open marriage to same-sex couples.

Same-sex marriage has been legal in Chiapas in accordance with a Supreme Court ruling issued on 11 July 2017 that the ban on same-sex marriage violated the equality and non-discrimination provisions of Articles 1 and 4 of the Constitution of Mexico. The ruling, published in the Official Journal of the Federation on 11 May 2018, legalized same-sex marriage in the state of Chiapas.

Same-sex marriage has been legal in Morelos since 5 July 2016. A bill to amend the State Constitution to legalize same-sex marriage in Morelos passed Congress on 18 May 2016 by 20 votes to 6. Ratification by a majority of the state's 33 municipalities was confirmed on 27 June 2016. The law was published in the official state gazette on 4 July 2016 and took effect the following day.

Same-sex marriage has been legal in Querétaro since 13 November 2021. On 22 September 2021, the state Congress passed a law legalizing same-sex marriage in Querétaro. The law was published in the state's official gazette on 12 November, and took effect the following day. Previously, same-sex couples could marry in eight of the eighteen municipalities of Querétaro, comprising 60% of the state's population, despite a state law prohibiting same-sex marriage.

Same-sex marriage has been legal in Baja California since 3 November 2017 when the Secretary General of Government, Francisco Rueda Gómez, instructed the state's civil registry to immediately begin issuing marriage licenses to same-sex couples and cease enforcement of the state's same-sex marriage ban. This was in line with jurisprudence established by the Mexican Supreme Court, which has ruled that same-sex marriage bans violate Articles 1 and 4 of the Constitution of Mexico. Previously, Baja California had banned same-sex marriage both by statute and in its state constitution.

Same-sex unions are currently not recognized in Honduras. Since 2005, the Constitution of Honduras has explicitly banned same-sex marriage. In January 2022, the Supreme Court dismissed a challenge to this ban, but a request for the Inter-American Commission on Human Rights to review whether the ban violates the American Convention on Human Rights is pending. A same-sex marriage bill was introduced to Congress in May 2022.

Same-sex marriage has been legal in Guanajuato since 20 December 2021. That day, the Secretary General of Government, Libia Dennise García Muñoz, issued an official directive addressed to officials of the state civil registry that, effective immediately, same-sex couples can marry in the state. Guanajuato became the 23rd Mexican state, and the 24th jurisdiction, to legalize same-sex marriage.

Same-sex marriage has been legal in Tabasco since 27 October 2022. A bill to legalise same-sex marriage was passed by the Congress of Tabasco on 19 October 2022. It was signed by Governor Carlos Manuel Merino Campos, and published in the official state journal on 26 October, taking effect the next day. Tabasco was the fourth-to-last state in Mexico to legalize same-sex marriage.

Same-sex marriage has been legal in Durango since 19 September 2022 in accordance with an executive order issued by Governor Esteban Villegas Villarreal the previous day, addressed to officials of the state civil registry that same-sex couples can marry in the state. The Congress of Durango passed same-sex marriage legislation three days later.

Same-sex marriage has been legal in Tamaulipas since 19 November 2022. On 26 October 2022, the Congress of Tamaulipas passed a bill to legalize same-sex marriage in a 23–12 vote. The bill was published in the official state journal on 18 November, and took effect the following day. Tamaulipas was the second-to-last state in Mexico to legalize same-sex marriage.

Wąska), pojęcie "wspólne pożycie" odnoszone jest wyłącznie do konkubinatu, a w szczególności do związku osób o różnej płci, odpowiadającego od strony faktycznej stosunkowi małżeństwa (którym w myśl art. 18 Konstytucji jest wyłącznie związek osób różnej płci). Tego rodzaju interpretację Sąd Najwyższy, orzekający w niniejszej sprawie, w pełni podziela i nie znajduje podstaw do uznania za przekonywujące tych wypowiedzi pojawiających się w piśmiennictwie, w których podejmowane są próby kwestionowania takiej interpretacji omawianego pojęcia i sprowadzania go wyłącznie do konkubinatu (M. Płachta, K. Łojewski, A.M. Liberkowski). Rozumiejąc bowiem dążenia do rozszerzającej interpretacji pojęcia "wspólne pożycie", użytego w art. 115 § 11 k.k., należy jednak wskazać na całkowity brak w tym względzie dostatecznie precyzyjnych kryteriów.

W piśmiennictwie podkreśla się, że art. 18 Konstytucji ustala zasadę heteroseksualności małżeństwa, będącą nie tyle zasadą ustroju, co normą prawną, która zakazuje ustawodawcy zwykłemu nadawania charakteru małżeństwa związkom pomiędzy osobami jednej płci (vide: L. Garlicki Komentarz do art. 18 Konstytucji, s. 2-3 [w:] Konstytucja Rzeczypospolitej Polskiej. Komentarz, Wydawnictwo Sejmowe, Warszawa 2003). Jest wobec tego oczywiste, że małżeństwem w świetle Konstytucji i co za tym idzie - w świetle polskiego prawa, może być i jest wyłącznie związek heteroseksualny, a więc w związku małżeńskim małżonkami nie mogą być osoby tej samej płci.
