List of Australian federal by-elections

Last updated

This is a list of by-elections for the Australian House of Representatives from its creation in 1901 until the present day.

Contents

Casual vacancies in the House of Representatives arise when a member dies, is disqualified or resigns, or for some other reason the seat becomes vacant. Members normally resign by tendering resignation to the Speaker of the House of Representatives.

Casual vacancies are filled by by-elections. The Speaker has a discretion as to when to call a by-election and may not call one at all, for example, if a general election is imminent. At least 33 days must elapse between the issue by the Speaker of a writ and the date of a by-election, and the Speaker cannot issue the writ until receipt of a formal letter of resignation. A by-election must take place on a Saturday.

A supplementary election is held in an electorate following a scheduled general election if the election is not held.

List of federal by-elections

In the following table, gains for the Australian Labor Party are highlighted in red, for the Liberal Party of Australia and its predecessors (including the Protectionist Party) in blue, for the National Party of Australia and its predecessors in dark green, the Australian Greens in light green and for others in grey. Seats that were retained by the respective parties remain white.

Brackets around a date indicate that the candidate was unopposed when nominations closed. These candidates were declared "elected unopposed" with effect from the date of the closing of nominations, as there was no need to hold a by-election.

A by-election, also known as a special election in the United States and the Philippines, a bye-election in Ireland, and a bypoll in India, is an election used to fill an office that has become vacant between general elections.

The electoral system of Australia comprises the laws and processes used for the election of members of the Australian Parliament and is governed primarily by the Commonwealth Electoral Act 1918. The system presently has a number of distinctive features including compulsory enrolment; compulsory voting; majority-preferential instant-runoff voting in single-member seats to elect the lower house, the House of Representatives; and the use of the single transferable vote proportional representation system to elect the upper house, the Senate.

In the Parliament of Australia, a casual vacancy arises when a member of either the Senate or the House of Representatives:

A writ of election is a writ issued ordering the holding of an election. In Commonwealth countries writs are the usual mechanism by which general elections are called and are issued by the head of state or their representative. In the United States, writs are more commonly used to call special elections for political offices.

In politics, a casual vacancy is a situation in which a seat in a deliberative assembly becomes vacant during that assembly's term. Casual vacancies may arise through the death, resignation or disqualification of the sitting member, or for other reasons.

Members of the New South Wales Legislative Assembly who served in the 25th parliament of New South Wales held their seats from 1920 to 1922. They were elected at the 1920 state election on 20 March 1920. The Speaker was Daniel Levy with the exception of 13–20 December 1921 when he was replaced by Simon Hickey.

The 2013 Australian federal election to elect the members of the 44th Parliament of Australia took place on 7 September 2013. The centre-right Liberal/National Coalition opposition led by Opposition leader Tony Abbott of the Liberal Party of Australia and Coalition partner the National Party of Australia, led by Warren Truss, defeated the incumbent centre-left Labor Party government of Prime Minister Kevin Rudd in a landslide. It was also the third time in history that a party won 90 or more seats at an Australian election. Labor had been in government for six years since being elected in the 2007 election. This election marked the end of the Rudd-Gillard-Rudd Labor government and the start of the 9 year long Abbott-Turnbull-Morrison Liberal-National Coalition government. Abbott was sworn in by the Governor-General, Quentin Bryce, as Australia's new Prime Minister on 18 September 2013, along with the Abbott Ministry. The 44th Parliament of Australia opened on 12 November 2013, with the members of the House of Representatives and territory senators sworn in. The state senators were sworn in by the next Governor-General Peter Cosgrove on 7 July 2014, with their six-year terms commencing on 1 July.

In the United Kingdom, a parliamentary by-election occurs following a vacancy arising in the House of Commons. They are often seen as a test of the rival political parties' fortunes between general elections.

The next Australian federal election will be held on or before 27 September 2025 to elect members of the 48th Parliament of Australia. All 150 seats in the House of Representatives and likely 40 of the 76 seats in the Senate will be contested.
